1. Introduction

Welcome to the MK Parking Payment System ("System", "Service", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our parking payment system operated by Elegant Aspire Sdn Bhd (Company No: 200801017132 (818425-M)).

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Definitions

• "Member" refers to any individual or entity registered to use the MK Parking Payment System
• "Credit" refers to the prepaid parking balance in your member account
• "Monthly Pass" refers to a subscription-based unlimited parking access for a specific location
• "Parking Facility" refers to any parking location integrated with our System
• "Transaction" refers to any credit reload, parking fee deduction, or pass purchase

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years old and possess a valid Malaysian IC or business registration to use this Service. By registering, you represent and warrant that you meet these requirements.

3.2 Account Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account

3.3 Vehicle Registration

You must register your vehicle(s) with valid Malaysian registration numbers. You may register multiple vehicles under one account. Any changes to vehicle registration must be updated promptly.

4. Use of Service

4.1 Credit System

• Credits must be purchased through our approved payment methods
• Minimum reload amount: RM 10.00
• Maximum reload amount: RM 1,000.00 per transaction
• Credits are non-transferable and cannot be exchanged for cash
• Credits have no expiration date unless otherwise specified
• You are responsible for maintaining sufficient credit balance for parking

4.2 Monthly Passes

• Monthly passes provide unlimited access to specified parking facilities
• Passes are location-specific and non-transferable
• Pass validity period begins from the date of purchase
• No refunds for unused pass periods
• Automatic renewal may be available subject to additional terms

4.3 Parking Fees

• Parking rates are determined by the facility operator
• Rates may vary by location, time, and duration
• We reserve the right to adjust rates with reasonable notice
• Fees are automatically deducted from your credit balance upon exit

5. Payment Terms

5.1 Payment Methods

We accept payment through:

• Credit/Debit Cards (Visa, Mastercard)
• Online Banking (FPX)
• E-Wallets (Boost, GrabPay, Touch 'n Go, ShopeePay)

5.2 Payment Processing

• All payments are processed securely through eGHL payment gateway
• Transaction fees may apply depending on payment method
• Payment confirmation may take up to 2 business days
• Failed payments will not result in credit addition

5.3 Currency

All transactions are conducted in Malaysian Ringgit (MYR).

6. Billing and Invoicing

• Electronic invoices (e-invoices) will be generated for all transactions
• Invoices comply with Malaysian MyInvois requirements
• Invoices are available in your member portal
• You must verify invoice details and report any discrepancies within 7 days

7. User Responsibilities

7.1 Compliance

You agree to:

• Comply with all applicable laws and regulations
• Follow parking facility rules and regulations
• Use the Service only for lawful purposes
• Not interfere with or disrupt the Service
• Not attempt unauthorized access to the System

7.2 Vehicle and Account Security

• Ensure your registered vehicle information is accurate
• Do not share your account credentials
• Report lost or stolen vehicles immediately
• Maintain sufficient credit for parking operations

8. Prohibited Activities

You must not:

• Use the Service fraudulently or in connection with criminal activities
• Impersonate another person or entity
• Register vehicles you do not own or have authorization to use
• Reverse engineer, modify, or interfere with the Service
• Use automated systems or bots to access the Service
• Resell or redistribute parking credits or passes

9. Service Availability

• We strive to provide continuous Service availability
• We do not guarantee uninterrupted or error-free operation
• We may suspend Service for maintenance with reasonable notice
• We are not liable for unavailability due to circumstances beyond our control

10. Limitation of Liability

10.1 Service Limitations

Elegant Aspire Sdn Bhd and its affiliates, directors, employees, and agents shall not be liable for:

• Loss of vehicle or property in parking facilities
• Damages to vehicles while using parking facilities
• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• System downtime or technical failures

10.2 Maximum Liability

Our total liability shall not exceed the amount of fees paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Elegant Aspire Sdn Bhd from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of third-party rights
• Your use or misuse of the Service

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting our customer support. Any unused credits may be refunded subject to our Refund Policy.

12.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account remains inactive for 24 months
• Required by law or regulation

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of modified Terms.

14. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

15. Intellectual Property

• All content, features, and functionality are owned by Elegant Aspire Sdn Bhd
• You may not copy, modify, distribute, or create derivative works
• All trademarks and logos are property of their respective owners

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

17. Dispute Resolution

17.1 Negotiation

In the event of any dispute, both parties agree to first attempt to resolve the matter through good faith negotiation.

17.2 Mediation

If negotiation fails, parties agree to mediation before pursuing legal action.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Elegant Aspire Sdn Bhd regarding the Service.
